NEW HOA LAW REQUIRES BETTER COMMUNICATION

As you know by now, a new 13-page homeowners' association (HOA) law, passed by the Kansas Legislature, became effective on January 1.

The Lakepoint Master HOA board is suggesting that individual neighborhoods have their covenants and bylaws professionally reveiwed and amended. (See story above.)

Thanks for notifying us of this new law! While it is long and tedious to read, it is important for all members, and especially the Board of Directors, to know its contents and provisions.<br /><br />Having been familiar with both the Bylaws and the Declarations of the LakePoint Master Association, I can see that this new law is more detailed and specific in several sections AND this new law takes precedence over the current LakePoint Bylaws and Declarations. Doing the same things the same ways and at the same times in 2011 as were done in 2010 will result in several violations. The Annual Meeting is one example. <br /><br />In 2011, the Annual Meeting must be held no later than October 15 and at least 10 days prior notice must be given to all members. Neither of these requirements were observed in 2010. Section 11-16 should be carefully read, discussed and applied by the Board to avoid noncompliance. It is paramount that the Board complies with the new law if they expect to enforce the new law for all HOA members. <br /><br />I suggest that a careful and thorough comparison be made of the new law versus the current Bylaws and Declarations and the necessary changes be implemented immediately in 2011. Failure to observe the stricter requirements of the new law is an invitation for problems later on.
